Users acknowledge and accept that participation in open water swimming carries inherent risks, including but not limited to the risk of serious injury. By agreeing to our Terms & Conditions, users confirm that they are voluntarily participating at their own risk and that are physically fit, capable, and free from any medical condition that may adversely affect the ability to swim safely in open water.
Users understand that it is their responsibility to seek medical advice prior to participation if they have, or suspect they may have, any pre-existing health conditions. In particular, individuals with cardiac, respiratory, or blood pressure concerns are strongly advised to consult their GP before taking part. Recommended checks include:
Cardiac screening (e.g., ECG with GP review).
Blood pressure measurement at a GP surgery.
For participants with asthma, bringing a clearly labelled inhaler to the lakeside.
- The use of the lakes and lakeside is done is done so entirely at your own risk.
- Participants must be able to swim 200m unaided and able to confidently tread water.
- Children over the age of 14 are permitted to swim during the summer swim calendar only but MUST be competent swimmers and always supervised by an adult in the water. Participants under the age of 18 are not permitted to ‘winter swim’.
- You must be medically fit and well to attend a session. Please inform Escape to the Lake / Riverlands Leisure of any injuries or health conditions/allergies that may affect you prior to a session.
- Please be respectful to ALL life in our lake and on our land and do not damage any flora or fauna.
- Please keep your distance from any nesting birds or occupied habitats.
- Please use designated entry and exit points, unless in an emergency. In a lake evacuation, the whistle will be blown consecutively.
- During the during the winter swim season (1st of October to the 31st April), we ask all swimmers to wear either a wooly / knitted / fleece hat or silicone swim cap.
- No jumping or diving is permitted at any time.
- Tow floats are to be worn at all times whilst swimming.
- In order to protect the ecosystem of the lake, please remove all chemical products such as sunscreen, oils and moisturiser. Please only wear ‘water safe’ suncream.
- All sessions and attendances must be in accordance with the Escape to the Lake / Riverlands Leisure timetable only.
- All litter must be taken home with you.
- It is strongly advised to remove contact lenses before entering the lake.
- No alcohol or drugs should be used onsite or prior to your visit.
- No self-lit fires.
- Escape to the Lake / Riverlands Leisure reserves the right to cancel a session at any time and cease access to any guest.
- All lakeside visitors, including those who are not swimming, must purchase a ticket. For the comfort and privacy of those using the lake, we do not allow anyone to ‘have a look around’.
- No dogs.
- Escape to the Lake / Riverlands Leisure, reserve the right to remove any guest from a session.
- During winter swim months, we ask that swimmers remain on site until 30 minutes after their swim to avoid unexpected after-drop. Any guest who is concerned about their temperature, or that of a fellow swimmer please speak to a member of staff as soon as possible.
- Bio security is of the highest importance and swimmers have a responsibility to protect this as a user of the lake. Please ensure all swim kit is washed thoroughly in-between swims and only use clean equipment and swimwear.
- Participants must report any injury / accident to a member of staff immediately.
- I accept that in the event of requiring medical attention Riverlands Leisure takes no responsibility for the treatment provided for any unreported existing condition which increases the risk of a medical emergency.
- I acknowledge that Riverlands Leisure has relied on this statement (in its entirety) in accepting my participation in Escape to the Lake swim sessions and that if I was unable or unwilling to agree to all the matters set out above in this statement of responsibility Riverlands Leisure would not allow me to participate. The use of the lakes and lakeside are done so at your own risk.
Terms and Conditions of this disclaimer notice applies to all customers attending the lakes and lakeside for an event run by the company.
- Introduction
1. Terms and Conditions have been outlined below to help you understand our responsibilities to you and your responsibilities to us. Please read these Terms and Conditions prior to booking. By making a Booking you confirm that you and all Members of your Group Booking have read, understood and accepted these Terms and Conditions. If you have any questions about these Terms and Conditions, we will be happy to help you.
1.2. Information about Riverlands Leisure trading as Escape to the Lake, we are a company registered in England and Wales, company number 11230183. You can contact us at hello@escapetothelake.co.uk
1.3. How we may contact you. If we have to contact you we will do so by telephone, email or by writing to you by using the contact details you have provided to us. By providing us with your contact details, you consent to our use of those contact details in all later correspondence between you and us. As such, please ensure the contact details you provide to us are correct and advise immediately of any changes.
- Definitions & Interpretations
2.1. The following definitions apply:
- Booking: means your booking to use the Facilities or any part of them.
- Booking Confirmation: means the confirmation of your Booking that is issued electronically once a Booking has been made by you.
- Booking Form: means the online booking form you must complete in order to make a Booking.
- Booked Session: the period of time you have booked to use the Facilities when making a Booking for an Event, Class or Session.
- Disclaimer: the disclaimer set out below.
- Facilities: means the facilities located at Riverlands Leisure – lake, outdoor sauna, toilet facilities, island studio, stretch tent, car park and firepit / seating areas.
- Group: means the named persons in your group on whose behalf you make a Booking.
- Member: means you, the person for whom we have agreed to make the Facilities available in accordance with these Terms and Conditions, including you and the other persons in your Group who are named when you make the Booking.
- Site: means lakes and carpark at Riverlands Leisure, Teme Lane, Leigh, Worcester, WR6 5JY.
- “we”, “us” and “our”: means Riverlands Leisure LTD trading as Escape to the Lake, Pippa Orgee Events at Riverlands Farm, Teme Lane, Leigh, Worcester, WR6 5JY.
- ‘You”, “your” and “yourself’: means the person or persons who makes a Booking and any Member of your Group and who will be bound by these Terms and Conditions.
- Booking
3.1. By completing the Booking Form, you agree and accept to be bound by these Terms and Conditions and by any other rules as displayed at the Site or as notified by us to you from time to time.
3.2. It is your responsibility to ensure that all Members of your Group Booking have read and confirmed their agreement to these Terms and Conditions before you proceed with the Booking.
3.3. Access to the Facilities will only be granted to those with a valid booking.
3.4. Your Booking gives you access to the Facilities or such part of them as named in the Booking Confirmation.
3.5. As part of the Booking, if you are booking on behalf of another adult, you must ensure the Terms of Use / Swimmer Responsibility and the Disclaimer have been agreed to by any other attendees. If you or any member of your Booking suffer from any medical condition or ailment, you must seek medical advice before using the Facilities or any part of them.
3.6. Once a Booking has been accepted by us and payment of the Booking has been made, we will send you a Booking Confirmation by email confirming the Booking and notifying you of details of the Facilities you can use under your Booking, details of your Booked Session and providing you with more information about the Facilities.
3.7. We may at our absolute discretion decline a Booking, and in such an event, if payment has been made a full refund will be made.
3.8. The term of your Booking shall be for the Booked Session only which will be outlined at the time of booking.
3.9. Your Booking may not be transferred or assigned to any other person, and you shall not allow your Booking to be used by any other person.
3.10. You must be at least 18 years old to make a Booking and all Members of your Group must also be 18 years old.
3.11. We may at any time terminate or suspend your Booking in the event of the following:
- 11.1. You are in breach of these Terms and Conditions.
3.11.2. You provide false details when making the Booking. - 11.3. You act in irresponsible manner, or your conduct brings our reputation into disrepute.
- 11.4. You or any Member of your Group Booking have not agreed to the Terms of Use / Swimmer Responsibility and our Terms & Conditions.
3.12. If we terminate your Booking for any of the reasons set out above, you shall not be allowed on the Site, or to enter the Facilities as either a Member, a guest, a Member of a Group Booking or otherwise
3.13. Each Booking must be made online in accordance with our Booking Form on our website.
3.14. A Booking is only valid for the parties named on the Booking Confirmation.
3.15. If you wish to reschedule your Booking to another session, you must let us know at least 48 hours in advance for swim bookings. For all other events, we require 14 days’ notice in writing. This can be done by emailing hello@escapetothelake.co.uk. We do not offer refunds for any booking made but will try and accommodate rescheduling where possible.
3.16. Access to the Facilities and the duration of a Booked Session may vary seasonally and in accordance with force majeure events and our operational needs.
- Privacy Policy
4.1. Our Privacy Policy is available at Privacy Policy – Wild swimming Worcestershire (escapetothelake.co.uk) Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
- Facilities and Terms of Conditions
5.1. You accept and agree to these Terms and Conditions, by reading these Terms and Conditions and then clicking on the box to confirm you agree and wish to Book. In doing so, you confirm that you have understood and agree with all aspects of these Terms and Conditions and their general intent and that you are giving up certain substantial legal rights including the right to sue. Where you exchange your ticket for another Event, your original acceptance of these Terms and Conditions will apply to that Event.
5.2. Any Ticket must be purchased by a responsible adult. Where you are accepting and agreeing these Terms and Conditions on behalf of a child under the age of 18 (only permitted during the summer season 1st April to the 30th September), you have explained to the child, and you both accept the risk and these Terms and Conditions and agree that the Company will not be liable for injury or damage to property as stipulated in these Terms and Conditions.
5.3. Where you are purchasing Tickets on behalf of other adults, thereby accepting and agreeing these Terms and Conditions, you have explained these Terms and Conditions to the persons on whose behalf you are purchasing Tickets and confirm they have authorised you and that you are so authorised to accept on their behalf, the risk and these Terms and Conditions and agree that the we / the company, will not be liable for injury or damage to property as stipulated in these Terms and Conditions.
5.4. You acknowledge that we / the company, have relied on your statements and representations in these Terms and Conditions in their entirety in accepting your participation in an Event and that if you were unable or unwilling to agree to all the matters set out in this Terms and Conditions, we / the Company would not allow you to participate. All statements of fact are true.
5.5. Once you have received a Booking Confirmation, we shall make the Facilities (or such part of them as is set out in your Booking Confirmation) available to you on the date and at the time of your Booked Session in accordance with these Terms and Conditions.
5.6. We reserve the right to vary, add or remove any of the Facilities and to close or withdraw the Facilities for repairs or other maintenance or for reasons beyond our control.
5.7. You may only use the Facilities if you have made a Booking and received a Booking Confirmation and agreed to our Terms of Use / Swimmer Responsibility and Terms and Conditions.
5.8. You use the Facilities at your own risk. You must observe all our rules, signs and notices. You must be a competent swimmer, meaning you can competently swim 200m and able to handle cold water exposure and not suffer from any injury, medical condition such as a heart condition, disease or illness, or be using prescription drugs which would make your use of the Facilities unsuitable.
5.9. If you are pregnant, you are not permitted to use the lakes for swimming. You are permitted to attend sessions where lake swimming isn’t part of the schedule of events. But please do consult your GP prior to attendance with any concerns or questions.
5.10. We test the quality of the lake water periodically to make sure that it is suitable for swimming. However, you should be aware that open water swimming can increase the risk of illnesses caused by micro-organisms such as norovirus, giardia and cryptosporidium, and whilst the symptoms will generally be mild, there is also a risk of more severe infections caused by micro-organisms such as E.coli. Therefore, if the quality of the lake water is not suitable for swimming, we will close the lake until the it is safe to resume and issues have been rectified.
5.11. When using the Facilities, you agree to sensible and responsible conduct, in compliance with all notices, instructions, induction, health and safety briefing and displayed or given directly by us.
5.13. You may not permitted to use the Facilities if you are under the influence of drugs or alcohol.
5.14. You must ensure all cuts/abrasions are covered prior to swimming with a suitable waterproof covering.
5.15. We reserve the right to refuse admission to any persons for any reason including but not limited to those of non-compliance with these Terms and Conditions and/or any behaviour or actions that may be deemed a health and safety risk. Refunds will not be offered to anyone refused admission.
5.16. Emergency contact information is displayed on Site. If you suffer an accident or injury at the Facilities or where any other incident occurs, please make it known to us immediately. Emergency contact numbers are provided in the Booking Confirmation and are displayed on site at the Facilities.
5.17. You must use the designated entrance and exit to the water. There is strictly no diving or jumping due to shallow water.
5.18. No dogs are allowed on Site (except for registered working assistance dogs) at the Facilities.
5.19. In the event of bad weather, or other environmental factors, Bookings may be varied or cancelled by us. In this instance, a full refund will be given.
5.20. Do not leave valuables or money at the Facilities. We will not be liable for the loss, theft or damage of such items.
- Additional Etiquette and Preparation
6.1. You should come prepared with swimwear, warm and water proof layers, water bottle, dry-robe/towel, footwear for the deck in hot weather and boots or trainers for the walk from the car park.Ff
6.2. You must not access any adjacent farmland and lakes: access is only permitted for use of the lake, carpark and lakeside areas.
6.3. Must wear shoes all times when not in the Lake. Swim footwear is recommended in the lake.
6.4. In the interests of public decency, swimwear must be worn at all times whilst using the Facilities.
6.5. We recommend that you do not use the Facilities if you have had a large meal in the 90 minutes prior to your Booking.
6.6. You may consider neoprene gloves, socks, wetsuits and swim hats, have dry clothes ready to change into and take particular caution in the winter.
6.7. Being set in nature, there are limited changing facilities.
6.8. In order to protect the ecosystem of the lake, please remove all chemical products such as sunscreen, oils and moisturiser, before arriving at the Site and when showering, please only use the eco-friendly products provided.
6.9. We ask winter swimmers to remain on-site for at least 30 minutes post swim to allow for any possible after drop.
6.10. Please wear appropriate swimwear, sit on a towel and avoid wearing jewellery or swimwear with metal accessories as these can burn. Metal water bottles should not be taken into the sauna.
6.11. Only use fresh water on the sauna stones and not lake water or any other substances. Water should only be sprinkled lightly on the stones to control the temperature and steam.
6.12. Please make sure that any litter is taken home with you.
6.13. Under 18 years old must be closely supervised by a responsible adult at all times.
6.14. All Tickets purchased are only valid on the date and time printed on the Ticket. Tickets cannot be transferred to another person.
6.15. People under the age of 18 are not permitted to winter swim (1st October to the 31st March)
6.16. You must not damage any flora of fauna in the lake, lakeside or on the surrounding farmland and keep your distance from any nesting birds.
6.17. All cars are parked entirely at a Customer’s risk
6.18. Tow floats must be worn at all times whilst in the lake.
6.19. It is strongly advised to removed contact lenses prior to swimming.
7. Limitation of Liability
7.1 We will not under any circumstances accept responsibility in respect of any damage to or loss of any goods, articles or personal property, or property of any kind brought into or left at the Site. Any lost property will be kept by us for 1 month after the Booking, after which time we have complete discretion to dispose of any lost property.
7.2 You are responsible to us for your behaviour. If we have reason to believe that your behaviour is unacceptable, dangerous or unlawful, we will in our absolute discretion be entitled to take such action against you as may be necessary to prevent such behaviour continuing. This may include ejecting you from the Site and refusing any future Bookings for you.
7.3 We are not liable for any injury, damage or loss to you, third parties or property incurred whilst using the Facilities or on Site.
7.4 Nothing in these terms limits or excludes our liability for death or personal injury resulting from our negligence or arising as a result of fraud or fraudulent misrepresentation.
7.5. We are not liable to you as a result of any delay or failure to make the Facilities available to you as a result of a force majeure event, which means an event beyond our reasonable control including, but not limited to, serious adverse weather conditions, unsuitable water quality in the lake, damage to the Facilities, pandemic or compliance with any law or governmental order, rule, regulation or direction.
8. Complaints
8.1. If you wish to make a complaint in relation to your Booking, please contact us by telephone or email. We will discuss with you the basis and cause of your complaint and will seek to address your complaint.
8.2. We will try to resolve any complaints with you quickly and efficiently. If you are unhappy with the services we have provided or any other matter, please contact us as soon as possible using the contact details set out at the top of this page.
8.3. The laws of England and Wales apply to these Terms and Conditions.
8.4. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
- General provisions
These Terms and Conditions shall be deemed to have been read, understood and accepted by you upon completing the Booking form.
9.1. The binding agreement between you and all Members of your Group Booking and us upon completing the Booking Form shall be governed in all respects by the Laws of England and you hereby submit to the exclusive jurisdiction of the English Courts.
9.2. A person who is not a party to these Terms and Conditions shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms and Conditions.
Disclaimer
This disclaimer notice applies to the Facilities operated by us. By making a Booking and using the Facilities you agree to be bound by the disclaimer notice (as set out below).
10.1 Wild swimming / Open Water Swimming / Cold Water Immersion & Swimming is a demanding and physical activity. There are risks associated with this activity that we cannot fully remove or mitigate. You should ensure that you are fully aware of the associated risks of participating in this activity. In particular, this includes the risk of personal injury. We strongly recommend that a Cold Water Immersion / Open water Swimming course is completed prior to participation, either at Escape to the Lake or another reputable swimming venue.
10.2. Participation is entirely at the Customer’s own risk.
10.3. The Customer gives full release and waiver of liability and claims that they have or may in future have against the Company, for all liability for any and all injury, illness, disability, death or loss or damage to persons and property, whether arising from the negligence of the company or otherwise, to the fullest extent permitted by law which a Customer may suffer arising out of their use of the Lake and/or presence at the Lakeside, due to any cause, including negligence of the Company or negligence in the administration of first aid , breach of contract, breach of statutory duty, or other duty of care;
10.4. The Customer agrees not to sue the Company for any loss, injury, cost or damages of any form or type, however caused or arising either directly or indirectly as a result of a Customer’s participation.
10.5. The Customer indemnifies and holds the Company harmless and releases the Company from any litigation expense, legal fees, liability, damage, award or cost of any type or form that the Company may incur due to any claim made against them by the Customer.
10.6. The Customer freely assumes all risks, both known and unknown, even if arising from the negligence of the Company, and assumes the full responsibility for their own participation.
10.7. Access to the Site is entirely at your own risk.
10.8. Use of the Facilities is entirely at your own risk.
10.9. Use of any equipment or property is entirely at your own risk.
10.10. We are not responsible or liable for any theft, damage, destruction or loss of your equipment, property or possessions on Site or at the Facilities.
10.11. you will be liable for any damage or loss caused by you.
10.12. We are not qualified to express an opinion confirming that you are fit to use the Facilities and you must ensure that you are fit to use the Facilities. You must not use the Facilities if you are suffering from any serious medical condition or have recently undergone surgery unless you have a certificate of your fitness to use the Facilities from your doctor. You must not use the Facilities if you are pregnant or under the influence of alcohol or drugs.
Governing Law and Jurisdiction
The laws of England and Wales apply to this disclaimer.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
